MAILLEEK TEMPORARY EMAIL SERVICE - COMPREHENSIVE LEGAL DISCLAIMER This legal disclaimer ("Disclaimer") governs your use of MailLeek.com ("MailLeek", "we", "us", or "our") temporary email services (the "Service"). By accessing or using the Service in any manner, you ("User", "you", or "your") expressly acknowledge, understand, and irrevocably agree to be bound by all terms and conditions set forth herein, as well as our Terms of Service and Privacy Policy, which are incorporated by reference. MailLeek provides an automated, self-service platform for generating temporary, disposable email addresses ("Temporary Addresses") solely for legitimate purposes including but not limited to software testing, quality assurance, email workflow verification, and personal privacy protection in circumstances where providing a permanent email address is undesirable. The Service is provided strictly on an "as is" and "as available" basis without any representations, warranties, or guarantees of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for particular purpose, non-infringement, or uninterrupted/error-free operation. MailLeek expressly disclaims any and all liability for the actions of its users and the content of communications transmitted through the Service. You understand and acknowledge that MailLeek functions merely as a passive conduit for the transmission of electronic communications and exercises no control whatsoever over the substance, nature, quality, or legality of any messages sent to Temporary Addresses, nor does MailLeek verify, authenticate, or validate the identity of individuals creating or accessing Temporary Addresses. As a condition of using the Service, you hereby represent, warrant, and covenant that: (a) you are at least 18 years of age or the age of legal majority in your jurisdiction; (b) you possess the legal right and capacity to enter into this agreement; (c) you will use the Service only for lawful purposes in strict compliance with all applicable local, state, national, and international laws, rules, and regulations; (d) you will not use the Service to engage in any fraudulent, deceptive, malicious, or illegal activities; and (e) you accept full and sole responsibility for all activities that occur under any Temporary Address you create or access. PROHIBITED USES AND ACTIVITIES You are expressly prohibited from using the Service, including but not limited to creating or accessing Temporary Addresses, in connection with any of the following activities, which are strictly forbidden and constitute material violations of this Disclaimer: (1) any unlawful, fraudulent, deceptive, or malicious purpose or activity; (2) phishing, spoofing, or other forms of electronic deception; (3) sending spam, junk mail, chain letters, or unsolicited bulk communications; (4) harassment, stalking, threats, or intimidation of any individual or entity; (5) dissemination of libelous, defamatory, abusive, profane, lewd, vulgar, obscene, pornographic, or otherwise objectionable material; (6) distribution of viruses, worms, Trojan horses, or other malicious code; (7) unauthorized access to or interference with computers, networks, or systems; (8) infringement of intellectual property rights including copyright, trademark, patent, or trade secret rights; (9) violation of export control laws or regulations; (10) money laundering, terrorist financing, or other financial crimes; (11) drug trafficking, arms dealing, or other illegal commerce; (12) child exploitation, child pornography, or any activities harmful to minors; (13) circumvention of security measures or authentication systems of any service, website, or network; (14) creation of fake accounts or false identities on third-party services; (15) bypassing email verification systems of websites or applications when such bypass violates their terms of service; (16) any activity that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service; (17) unauthorized commercial use or resale of the Service; (18) automated creation of Temporary Addresses through scripts or bots without explicit permission; (19) collection or harvesting of information about other users; or (20) any other activity that MailLeek, in its sole discretion, determines to be inappropriate or harmful. USER RESPONSIBILITIES AND ACKNOWLEDGMENTS You expressly acknowledge and agree that you are solely and entirely responsible for all activities conducted through any Temporary Address you create or access, and for the consequences of such activities. MailLeek assumes no responsibility or liability whatsoever for any user conduct or content transmitted through the Service. You understand that Temporary Addresses and their contents are automatically and permanently deleted from our systems after a short period (typically 1-2 hours), and that MailLeek does not provide any archiving or backup services for messages received by Temporary Addresses. You further acknowledge that certain sensitive emails (including but not limited to those from government agencies, financial institutions, and messages sent to common administrative addresses such as abuse@, postmaster@, admin@, etc.) may be automatically blocked by our systems and never delivered to Temporary Addresses. You agree that MailLeek may, in its sole discretion and without prior notice or liability, terminate your access to the Service or delete any Temporary Address if it believes you have violated this Disclaimer or any applicable laws. You understand that MailLeek reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice, and that MailLeek shall not be liable to you or any third party for any such modification, suspension, or discontinuance. DATA RETENTION AND LAW ENFORCEMENT COOPERATION While MailLeek does not routinely monitor or review the content of messages sent to Temporary Addresses, you acknowledge and agree that MailLeek may collect, retain, and disclose certain information about your use of the Service, including but not limited to: (a) IP addresses used to access the Service; (b) timestamps of Service access and usage; (c) browser and device information; (d) the Temporary Addresses created; and (e) metadata about messages received (such as sender address, subject line, and size). MailLeek will fully cooperate with any law enforcement authorities, court orders, or subpoenas requesting or directing MailLeek to disclose such information in connection with investigations of alleged illegal activity. You expressly consent to such disclosure and waive any claims against MailLeek for complying with legal process. MailLeek may also disclose such information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. In cases involving child exploitation material, MailLeek will immediately report such content to the appropriate authorities including the National Center for Missing and Exploited Children (NCMEC) and/or other designated agencies as required by law. LIMITATION OF LIABILITY AND INDEMNIFICATION To the maximum extent permitted by applicable law, in no event shall MailLeek, its affiliates, officers, directors, employees, agents, or licensors be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from (a) your use of or inability to use the Service; (b) any unauthorized access to or alteration of your transmissions or data; (c) any content or conduct of any third party using the Service; or (d) any other matter relating to the Service. In no event shall MailLeek's total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months preceding your claim. You agree to defend, indemnify, and hold harmless MailLeek and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of this Disclaimer; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Service caused damage to a third party. This defense and indemnification obligation will survive termination of this Disclaimer and your use of the Service. You may not assign, transfer, or sublicense this Disclaimer without MailLeek's prior written consent. MailLeek may assign or transfer this Disclaimer, in whole or in part, without restriction.
